Get out of your 3 contract early now

I called 3 today to cancel. I spent a good 40 minutes trying to convince them that I had the right to be released. The operator told me that I had received a text on 15/5/09 telling me about the changes and that I had 4 weeks to contact 3. Fortunately I still had the text, but it didnt mention any time period for contacting 3. The operator then told me that it was a time limit that 3 set internally. I tried to explain to him that how was the customer supposed to know about a time limit on contacting 3, he said it is human nature to repsonse to text messages right away. Immediately this sounded like bulls**t to me and I told him so.
I expalined that was going to cancel direct debit. I just concerned that this could damage my credit rating if they black list me for non payment.
Can anyone advise me on what to do next, should I contact ofcom and report this???

This section in the contract:

10.1(d) You can end the agreement within one month of us telling you about a variation to your agreement (which includes your Price Plan) which is likely to be of detriment to you. You must give written notice to 3 Customer Services within that month and your agreement will finish at the end of that month once we receive your notice. (A Cancellation Fee will not be charged.)

Seems to suggest you do need to end it within a month of being notified of the change in t&c. Legally I'm not sure if this breaks statutory rights...I do know contracts can be implied after a certain time period like employment contract changes without the individual having to accept them.

It's not going to stop me from trying, and argue I didn't receive notification.

Hi i would just like to thank redmozzy because today i got out of my contract free. i have been trying to get out of it since i read redmozzy first comment about getting out of a 3 contract. i didnt think it would work to start with but i did what redmozzy said and i got out of it quite easily today after by third call. if there is anyone who wants end there contract with 3 my advise would be to be polite to them and never ever give up as they will let you out in the end for free

no problem at all, I was so frustrated with 3 as I was in a high tariff contract that I couldn't get out of until next January. Yes I took out this contract on this tariff but this is a problem with all companies, what it right for you now, may not be a year down the line so being tied up in 18/24 month contracts are bad for us consumers. My thanks go to Nate for brining it up to start with.

hi guys,

Interesting thread here. One question I have before I have a go at this his weekend is this. I have my 3 phone through carphone warehouse. Should this make a difference when I phone up???

The thing is I have always had complete cover on my phone when I get one through cpwh but the silly women changed it to lite when I got my current phone. And as I have signed it they wont let me cancel my contract that way. I have now moved in with my gf and the signal in our house is rubbish. So this seems like a good idea now to try and get on a better coverage network.

Or am I to late now??? i hope not

Shouldn't make any difference as the contract is still with 3 even if it's via a 3rd party

You may be too late now but I would give it a go anyway

Damn, I knew I should have acted when I heard Nate on the Podcast. Nevermind. I'm about to try and get out of 4 contracts, 3 end in October and one still has a year to run. Should be fun.

Will keep ya posted.

Hello. I've just been on the phone to 3, i'm trying to get out of my new contract which i agreed to in Feb. This contract didn't start until May, although i've got a letter dated February which came with my new handset and payment terms. I'm just waiting for a phonecall from a manager from 3, to try and sort something else out. i know you said we might be too late, but do you think the date of the official start of the contract will be an issue. or do you think i've got a case because of the letter?

i know this thread is old, but just incase anyone else is still thinking of trying this, it will no longer work. they have this stupid thing in their small print where you have exactly one month to react to any change in the contract, after which it's hopeless.

i ended up coughing up £120 to end my contract, but i'm just glad to be rid of that company. with o2 now - SO much better - you can tell they care about their customers.

never going back to three.

Alright mate!! I upgraded my contract with three apparently just after they made the change to the terms! I'm on with them now, they offered to take £15 off my bill every month, is this an admission of guilt????
